The electoral advertisement for Election 2022 was released on Tuesday (16). But to avoid problems and punishments during the online campaign, which has been widely used in recent elections, voters and candidates should pay attention to the rules not to do bad things on the web and be banned from the networks.
We have gathered here some of the main prohibited practices on social networks during the electoral period, according to the rules released by the Superior Electoral Court (TSE). Check.
1. Make electoral poll

Take a poll with followers , as if it were an electoral poll, is not allowed. Profiles that carry out and disclose this type of survey may be required to exclude it. Previously, the use of the resource during the election could result in a fine, but recent changes in legislation removed this punishment.
2. Carry out paid electoral propaganda

Advertising is allowed on websites, blogs and profiles of candidates, parties, party federations and coalitions, as long as the addresses are informed to the Electoral Court. However, there is no authorization to serve paid ad.
Payment for content boost is an exception to this rule, but the action must be clearly identified and cannot be made by supporters, whether individuals or legal entities.
3. Trigger mass messages without the recipient’s consent

The sending of electronic messages to voluntarily registered voters is allowed during the electoral period. But the sender must be identified, offer means of unsubscribing and comply with the definitions of the General Data Protection Law (LGPD).
Shooting mass messages to people who were unwilling to receive them is prohibited by the TSE. This type of action was the reason for complaints in the 2018 elections and can lead to cancellation of candidacy registration , among other punishments.

The realization of concert to promote candidates, with the presentation of artists, paid or not, is also prohibited. This applies to face-to-face events and broadcasts on social media (“livemício”) or other online platforms.
Only concerts and events to raise funds for the campaign are allowed, without request for votes.
5. Disclose misinformation

A electoral misinformation on social media is one of the most debated topics by the TSE since the beginning of the year, including partnerships with Facebook, Instagram, Twitter, Google, TikTok and WhatsApp, among other services.
The body created official channels on the platforms in order to develop actions to prevent the spread of false content about the polls, the electoral process and that ridicule candidates.
6. Inform the wrong number of the candidate

Disseminating false information on social media to confuse voters, such as the wrong candidate number, can result in punishment. In addition to having the post removed, as has already happened in this campaign on Twitter, the user can be banned from the platform and respond to criminal proceedings.
